What Happens When You Get Injured at Work in NSW?

Suffering an injury at work can be stressful, overwhelming, and confusing. Not only are you dealing with pain and medical treatment, but you may also be concerned about your income, job security, and the process of making a workers compensation claim. If you’re injured at work in New South Wales (NSW), it’s important to understand your rights and the steps involved in accessing support.

1. Report the Injury Immediately

The first step after any workplace injury is to notify your employer as soon as possible. This can be done verbally or in writing, but it’s always a good idea to keep a written record (such as an email or text message) confirming the date, time, and details of the injury.

Your employer is legally required to record the incident in their workplace injury register and provide you with information about your rights under the NSW workers compensation scheme.

2. Seek Medical Treatment

Your health and safety come first. Seek medical attention as soon as possible from your GP or a hospital. Let your doctor know the injury happened at work so they can complete a Certificate of Capacity, which is essential for your workers compensation claim.

This certificate will outline your injury, your capacity for work, and any treatment you may require.

3. Lodge a Workers Compensation Claim

In New South Wales, workers compensation is managed by Icare, self-insurers, or specialised insurers depending on your employer.

To make a claim:

  • Complete a Worker’s Injury Claim Form
  • Provide your employer with a copy of your Certificate of Capacity
  • Submit the Worker’s Injury Claim Form and Certificate of Capacity to your employer (if you cannot get in touch with your employer, you can lodge the forms through Icare (Icare online form, phone or email)
  • Your employer must then notify their workers compensation insurer within 48 hours of becoming aware of the injury

The insurer will contact you and assess your claim. They usually have up to 21 days to make a decision.

4. Entitlements You May Receive

If your claim is accepted, you may be entitled to a range of benefits under the NSW Workers Compensation Scheme, including:

  • Weekly payments to cover lost wages
  • Medical, hospital and rehabilitation expenses
  • Domestic assistance
  • Lump sum compensation for permanent impairment (if applicable)
  • Support to help you return to work safely

It’s important to note that the system has time limits and eligibility criteria, so acting quickly and following the correct procedures is essential.

5. What If Your Claim Is Disputed?

Sometimes, insurers reject claims or dispute the level of support you’re entitled to. If this happens, you don’t have to face it alone. You can seek help from:

  • Your solicitor
  • The Independent Review Office (IRO)
  • The Personal Injury Commission (PIC)

At Goodman Spring, we regularly help injured workers challenge unfair decisions and access the compensation they deserve.

6. How Can a Workers Compensation Lawyer Help?

Navigating the NSW workers compensation system can be complex. An experienced workers compensation lawyer can:

  • Help you lodge your claim
  • Review decisions made by the insurer
  • Represent you in disputes or appeals
  • Advise on potential lump sum entitlements for permanent impairment

Legal fees for injured workers are usually covered under the IRO scheme, which means you won’t have to pay out of pocket for most legal help.
